Terms of Use for Sal

Welcome to Sal! These Terms of Use ("Terms") govern your access to and use of our mobile application Sal (the "App") and related services (collectively, the "Services") provided by Bokhan Creative Ltd ("we," "us," or "our"). By accessing or using the App, you agree to be bound by these Terms. If you do not agree, please do not use our Services.

2. Licence to Use

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, and revocable license to download and use the App for personal, non-commercial purposes. This license does not grant you any rights to the source code or intellectual property of the App.

3. Eligibility

The App is intended for users who are at least 13 years old. By using this app, you confirm that you are 13 years of age or older. If you are under 13, please do not use the App.

4. Description of the App

The App is designed to help you capture and keep photos with a film-inspired, warm aesthetic. All photos captured or imported into the App are stored locally on your device and are private to you. Registration is not required to use the App; however, a valid Apple ID is necessary to download the App from the App Store.

5. User Responsibilities

5.1 The App is intended solely for personal use. By using the App, you agree to capture, import, or upload only content you own or for which you have permission to use.

5.2 You are responsible for the photos and content you create or store within the App, and for complying with applicable laws and regulations regarding content capture and storage.

5.3 You are responsible for taking appropriate security measures to protect your photos, such as setting up device authentication and making regular backups.

6. Usage Restrictions

You agree not to capture, upload, or store any content that is illegal, harmful, inappropriate, or that may infringe on the rights of others. Bokhan Creative Ltd reserves the right to disable access to or terminate the Services for users who engage in prohibited conduct.

7. Subscriptions and Purchases

7.1 The App offers in-app purchases and subscriptions for additional features. These transactions are processed through the App Store using your Apple ID and are subject to Apple's terms and conditions.

7.2 We use Adapty to manage subscription infrastructure, including entitlement delivery and paywall presentation. For more details on how Adapty handles data, please refer to Adapty's Privacy Policy.

7.3 Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period. You can manage or cancel your subscription at any time in your Apple ID account settings under Subscriptions.

7.4 For any issues related to purchases, refunds, or payment support, please consult Apple Support directly.

8. Intellectual Property Rights

8.1 The App's design, code, interface, and branding are owned by Bokhan Creative Ltd. You may not copy, modify, distribute, reverse engineer, extract, replicate or use any part of the App's code or design outside the permitted functionality within the App.

8.2 You retain ownership of the photos and content you create or store in the App. We do not access or claim ownership over any user-generated content.

9. Termination of Use

You may stop using the App at any time. We reserve the right to suspend or terminate your access to the Services if you violate these Terms.

10. Termination of the App

We reserve the right to modify, suspend, or discontinue the App, in whole or in part, at any time and without notice. While we aim to provide an ongoing service, we are not obligated to continue development or support indefinitely.

11. Disclaimer of Warranties

The App is provided "as is" and without warranty of any kind. We do not guarantee that the App will be error-free or uninterrupted. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including but not limited to fitness for a particular purpose, merchantability, and non-infringement.

Data Loss Disclaimer: We are not responsible for any data loss that may occur due to technical issues, app deletion, or other causes. Users are encouraged to back up their photos regularly outside of the App.

Device or Software Issues: We are not liable for any damages arising from the use of the App, including issues with device performance or compatibility.

Unauthorized Access: In the event of a lost or stolen device, we are not liable for any unauthorized access to your data.

12. Limitation of Liability

To the maximum extent permitted by law, Bokhan Creative Ltd shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from your use of, or inability to use, the App, even if we have been advised of the possibility of such damages.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of England and Wales, without regard to its conflict of law principles. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales. Users are also responsible for complying with local laws applicable in their jurisdiction.

14. Modifications to the Terms

We reserve the right to modify or update these Terms at any time. Any changes will be effective immediately upon posting the revised Terms within the App. It is your responsibility to review the Terms periodically — continued use of the App after any modification constitutes your acceptance of the revised Terms.
